CPRs in Albania are legitimate, but Italy must ensure asylum protections

(ANSA) - BELGRADE, JUN 11 - EU countries can establish migrant centres outside the European Union, but "they remain required to respect the guarantees provided by EU asylum law," according to Laila Medina, Advocate General of the Court of Justice of the European Union, in her conclusions on the Italy-Albania protocol. According to Medina, the protocol and Italian implementing legislation "do not appear to contain clear and precise rules capable of guaranteeing the full range of rights" enshrined in the EU, such as "defence, respect for private and family life, and immediate release upon expiry of the detention validation period." Thus, these provisions "may affect or modify the minimum procedural guarantees provided by EU law." The court's decision is expected in the coming months. (ANSA).
