Member states can decree safe third countries: EU lawyer

(ANSA) - BELGRADE, APR 10 - "A Member State may designate safe countries of origin by legislative act and must disclose, for the purposes of judicial review, the sources of information on which the designation is based," wrote the Advocate General of the EU Court of Justice, Richard de la Tour, in his conclusions on the cases involving the Italy-Albania protocol and the definition of safe country of origin. The Member State "may, under certain conditions, grant a third country the status of safe country of origin, while at the same time identifying limited categories of persons who could be subject to the risk of persecution or serious violations," he added. The decision is expected between the end of May and the start of June. (ANSA).
